FINDRY TERMS OF SERVICE

Welcome to Findry, a mobile application developed and operated by Kaymer LLC (“Findry,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of the Findry mobile application, related services, and any associated features provided by Kaymer LLC.
By creating a Findry account, downloading the App, purchasing a subscription, or using Findry, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the App.

1. ELIGIBILITY
You must be at least 13 years of age to use Findry.
By using the App, you represent that you have the legal authority to enter into these Terms and that the information you provide is accurate and complete.
If you are using Findry on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

2. DESCRIPTION OF THE SERVICE
Findry is a field documentation and jobsite memory application designed to help construction professionals, contractors, tradespeople, maintenance personnel, and other field workers organize important project information.
Depending on the features you use, Findry allows you to:
Create and organize projects.
Save field records.
Attach photos to records.
Store measurements and reference points.
Record notes, materials, and warning information.
Track important installation details.
Retrieve previously saved field information.
Findry is intended solely as a documentation tool.

3. ACCOUNTS
A Findry account is required to use the App.
You agree to:
Provide accurate and current account information.
Maintain the security of your login credentials.
Keep your password confidential.
Notify us promptly if you believe your account has been accessed without authorization.
You are responsible for all activity that occurs under your account.

4. FREE PLAN AND FINDRY PRO
Findry offers both a Free Plan and an optional paid Findry Pro subscription.
Free Plan
The Free Plan currently includes:
Up to 3 projects
Up to 10 total records
Up to 3 photos per record
Up to 2 reference points per record
Local storage on your device
If you reach the Free Plan limit, you can delete existing records to free up space for new ones or upgrade to Findry Pro for unlimited records.
Free Plan limits may change as Findry evolves.

Findry Pro
Findry Pro currently includes:
Unlimited projects
Unlimited records
Up to 100 photos per record
Unlimited reference points
Secure cloud backup of supported project and record data
Access to current and future Findry Pro features included with your subscription
Photos attached to records remain stored locally on your device and are not currently included in cloud backup.

5. SUBSCRIPTIONS AND BILLING
Findry Pro subscriptions are offered on a monthly and annual basis through the Apple App Store and Google Play Store.
When you purchase a subscription:
Payment is charged to your Apple ID or Google Play account when the purchase is confirmed.
Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours before the current subscription period ends.
Subscription pricing is displayed within the App before purchase.
You may manage or cancel your subscription at any time through your Apple ID or Google Play subscription settings.
If you reinstall the App or change devices while using the same store account, you may restore your eligible subscription using the Restore Purchases feature available within the App.
Findry does not process or store your payment card information. Payments are securely handled by Apple or Google, depending on your platform.

6. IMPORTANT SAFETY DISCLAIMER

Findry is not a utility locating service.
Findry does not detect, identify, verify, or map underground utilities, pipelines, cables, water lines, gas lines, sewer lines, fiber optic lines, electrical infrastructure, or any other buried facilities.
All information stored within Findry is entered by users and may be incomplete, inaccurate, outdated, or incorrect.
Field conditions can change over time.
You are solely responsible for verifying all information before performing excavation, drilling, digging, demolition, construction, or any other activity that could affect underground or above-ground infrastructure.
Kaymer LLC is not responsible for any property damage, personal injury, utility strikes, project delays, financial loss, or other damages resulting from reliance on information stored within Findry.
7. USER CONTENT
You retain ownership of all content you create and upload within Findry, including but not limited to:
Projects
Records
Photos
Notes
Measurements
Reference points
Materials
Warning information
Emergency information
Any other information you choose to save within the App
By using Findry, you grant Kaymer LLC a limited, non-exclusive, revocable license to store, process, display, synchronize (where applicable), and transmit your content solely for the purpose of operating and providing the Findry service.
We do not claim ownership of your content.
You are solely responsible for ensuring that any information you store within Findry is accurate, lawful, and that you have the right to use or upload it.

8. DATA STORAGE
Findry stores information differently depending on your subscription level.
Free Plan
For Free users:
Projects and records are stored locally on your device.
Photos remain stored locally on your device.
Cloud backup is not included.
Findry Pro
For Findry Pro users:
Eligible project and record information may be securely backed up using Firebase cloud services.
Cloud backup currently includes supported project and record information but does not include record photos.
Photos remain stored locally on the device where they were captured or imported.
Kaymer LLC is not responsible for data loss resulting from:
Device damage
Device replacement
Device reset
Uninstallation of the App
Loss of locally stored photos
User deletion of records or photos
Circumstances beyond our reasonable control
Users are responsible for maintaining their devices and understanding the current cloud backup capabilities of Findry.

9. INTELLECTUAL PROPERTY
The Findry application, including its software, design, graphics, logos, trademarks, branding, icons, text, and other original content, is the property of Kaymer LLC or its licensors and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not:
Copy
Modify
Distribute
Sell
License
Reverse engineer
Decompile
Create derivative works from
Exploit any portion of the App
without prior written permission from Kaymer LLC.

10. PROHIBITED USE
You agree not to use Findry to:
Violate any applicable law or regulation.
Upload unlawful or fraudulent content.
Attempt to gain unauthorized access to the App or its systems.
Reverse engineer, decompile, or modify the App.
Interfere with the security or operation of the App.
Share your account credentials with others.
Use the App in a manner intended to disrupt other users or the service.
Misrepresent ownership of projects or records.
Violation of these Terms may result in suspension or permanent termination of your account.

11. ACCOUNT SUSPENSION OR TERMINATION
Kaymer LLC reserves the right to suspend or terminate access to Findry if:
These Terms are violated.
Fraudulent or abusive activity is detected.
Use of the App threatens the security or operation of the service.
Required by applicable law.
Where appropriate, we may investigate suspected misuse before taking action.
Termination of your account does not relieve you of obligations incurred before termination.

12. DISCLAIMER OF WARRANTIES
Findry is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, Kaymer LLC disclaims all warranties, whether express, implied, or statutory, including warranties of:
Merchantability
Fitness for a particular purpose
Non-infringement
We do not guarantee that:
The App will operate without interruption.
The App will always be error-free.
Information stored within the App will always remain available.
Every feature will operate under every circumstance.

13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Kaymer LLC, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to:
Your use of Findry.
Your inability to use Findry.
Loss of data.
Loss of business.
Loss of profits.
Construction delays.
Utility strikes.
Property damage.
Personal injury.
Any reliance on user-created records or documentation.
Your use of Findry is at your own risk.

14. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.
Any legal dispute arising under these Terms shall be resolved in a court of competent jurisdiction located within Massachusetts, unless otherwise required by applicable law.

15. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices.
When material changes are made, we will update the Effective Date shown at the top of these Terms.
Your continued use of Findry after updated Terms become effective constitutes your acceptance of the revised Terms.

16. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Failure by Kaymer LLC to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
